Bespoke Home Plans License Agreement

Please read carefully.  This license contains terms by which you are bound if you use the plans and specifications (hereinafter “the plans”) to construct a home.

License Agreement and Copyright Notice

All of the house plans on bespokehomeplans.com are protected under the Federal Copyright Act, Title XVII of the United States Code. Our house designers retains title and ownership of the original plan documents and retains the copyright in the plans, which includes the right to control copying and alteration of the plans as well as construction of a house based on the plan. The house plan licensed to you may not be resold or used by any other person. Whether you have the right to copy or modify a house plan or to construct a house based on a plan depends on the type of plan you purchase.

Copying and Modification Rights

To obtain the right to copy or modify a house plan, you must purchase an electronic PDF file or request an electronic CAD File.  When you request a Pricing Set, you do not have the right to copy or modify the plan.

If an electronic PDF file or CAD file has been purchased, the Licensee is granted the right to make copies as needed for the construction of one structure per plan purchase.  Any other copying is unauthorized.  The Licensee may be held legally responsible for any copyright infringement that is caused or encouraged by the failure to adhere.

Construction License and Compliance with Codes

When you purchase a Bespoke Home Plans house plan in the form of a PDF File or CAD File, you, as Licensee, obtain the right to use these documents to construct a single house and for no other purpose.  Bespoke Home Plans authorizes the use of these plans expressly conditioned upon your obligation and agreement to strictly comply with all local building codes, ordinances, regulations and requirements―including permits and inspections at the time of construction. Due to differences in time and place and continuing changes in national codes, the plan you order may need to be modified to comply with the codes in your area.

Bespoke Home Plans DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO ALL HOUSE PLANS, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.  IN NO EVENT WILL BESPOKE HOME PLANS, LLC. BE LIABLE FOR INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING ECONOMIC LOSS, DAMAGE TO PROPERTY, AND, TO THE EXTENT PERMITTED BY LAW, DAMAGES FOR PERSONAL INJURY.  ANY MODIFICATIONS OF THE PLANS VOIDS ANY WARRANTIES EXPRESS OR IMPLIED.  

 

Refunds / Exchanges

We cannot honor requests for refunds or exchanges.  Therefore it is important that prior to ordering, you fully determine that a particular plan will fulfill your needs.

Local Conditions

Bespoke Home Plans has put substantial care and effort into the creation of our drawing packages.  The plans have been prepared to meet generally accepted professional standards and practices and have been developed without knowledge or reference to a specific site or geographical location.  Local site conditions, such as frost depth, soil bearing capacity, seismic and wind zones, exposure, etc. may vary.  Local code requirements for such life-safety requirements as stair width, stair rise and run, egress windows and smoke detectors, etc. may vary. The strength of materials (such as lumber) available locally may vary.  Therefore, supplemental to these documents, it is the Licensee’s responsibility to consult with his/her local builder and a professional designer or structural engineer to determine that these documents meet all current federal, state/provincial and local codes, ordinances/bylaws and regulations, etc., and are appropriate to specific site conditions.  Compliance with such requirements shall take precedence over these documents.

 

Changes

Any use of this information without adaptation to changes in codes, standards, site conditions and other factors is at the Licensee’s sole risk.  Bespoke Home Plans assumes no responsibility for changes made to these plans by others and makes no warranties, either express or implied, in the use of these plans.  The Licensee agrees to defend and indemnify Bespoke Home Plans for all claims, losses or damages resulting from the use of these documents.

 

Architectural and Engineering Seals

Some cities and states require that a licensed architect or engineer review and "seal" a blueprint, or officially approve it prior to construction due to concerns over energy costs, safety and other factors. Prior to application for a building permit or the start of actual construction, we strongly advise that you consult your local building official who can tell you if such a review is required. Bespoke Home Plans, LLC. can not provide such a seal or stamp of certification.  It is your responsibility to determine if such seal is required and, if so, you are liable for any costs to obtain such a seal.

 

Before Construction

Before starting construction, it is the builder's responsibility to check all dimensions and details, and verify conformance with governing code requirements for the geographic area in which the house is to be built.  All structural, mechanical and electrical requirements shall also be reviewed before construction begins.  Codes govern over drawings and dimensions govern over scale. Notify the architect of dimensional discrepancies.

 

Framing Sizes and Engineered Components

Our plans are designed to utilize pre-engineered lumber components such as Wood I-Joist Framing, Laminated Veneer Lumber Beams and pre-engineered Floor or Roof Trusses.  Since the allowable loads of these various components vary from manufacturer to manufacturer and local and state building code requirements vary, the specific size, spacing and grade of these components will need to be verified by the manufacturer of the product or your local structural engineer.  Your builder should work closely with the lumber supplier and engineer to finalize these details, and ensure they fit properly within the construction of the home.

 

Construction Supervision

Bespoke Home Plans has not been engaged for construction supervision of any kind and assumes no responsibility to ensure that construction conforms to these plans, nor has any responsibility for construction means, methods, techniques, sequences, procedures or safety precautions in connection with the work.
